Farhus Group OU, a private limited company registered in Estonia with its address at Sepapaja tn 6, 15551 Tallinn, Estonia (“Farhus”), provides web hosting, domain name registration, SSL certificates registration, and other related products and services.

Farhus is committed to maintaining the highest level of data privacy when offering its quality products and services to its subscribers and customers (“Subscribers”) (collectively, “You” or “Users”).

At Farhus, we prioritize the privacy and security of our Users. We are dedicated to safeguarding the information you share with us.
In this Policy, “Farhus”, “we,” “us”, or “our” refers to Farhus, which is responsible for protecting your personal information through this Privacy Policy (“Data Controller”).

All and any information stored on Farhus’s Platform is treated as strictly confidential. All information is stored securely and is accessed by qualified and authorized personnel only.

3. COLLECTION OF INFORMATION

3.1. Information provided by you
We require and collect certain personal information from you when you use the Farhus Platform.

This information is necessary to fulfill the contractual arrangement between you and us and to comply with our legal obligations. Failure to provide this information or objection to processing this data may result in the deactivation of your Farhus Account.

• Account Signup Information: When signing up for Farhus, you must provide your email address and password. Sometimes, we may require additional information such as your first and last name, identity verification, and contact details. This information is necessary for domain name registration and is indicated as WHOIS information.
• Login Information: We collect Login scope and Email scope from Google and email from Facebook. Please refer to https://developers.google.com/identity/protocols/oauth2/scopes?hl=en for more information.
• Identity Verification: To comply with ICANN rules before registering a new domain name, Farhus may require identity verification information such as images of your passport, national ID card, valid driver’s license, or other documents as required by applicable laws.
• Payment Information: To use features of the Farhus Platform, we may require financial information to process payments. We use third-party payment processor services and do not collect or store credit card information. We only receive information about the payment status and store the last four credit card digits.
• Communications, Chats, Messaging: When you communicate with Farhus through the general inquiries window, we collect information about your communication and any information you disclose. To respond to your request, we may access information from your Farhus Account, purchase history, etc.
• Job Applicants’ Information: We collect information from applicants for open career positions published on https://farhus.eu/career or by email. Please refer to Section 5 below for more details.
• Visitors and Users-of-Users: We may collect information from visitors and users of our User’s websites or services solely on behalf of our Users.

You can provide us with information when filling in a form, conducting a search, updating or adding information to your Farhus Account, responding to surveys, posting to community forums, participating in promotions, or using other features of the Farhus Platform. However, we advise against posting any information you do not want to make public on the Farhus Platform. If you upload any content to your Account or post it on your Website and provide it in any other way as part of the use of any Service, you do so at your own risk.
LEGAL BASIS FOR PROCESSING YOUR INFORMATION

Farhus processes the information you provide to us based on the following legal bases:

• Your consent, expressed when voluntarily submitting and filling in your Data details in signup forms, by email, request or inquiries window, etc.; and
• The conclusion and performance of contractual arrangements and obligations between Farhus and the User;
• Pursuing legitimate interests of Farhus as Data Controller and manager of Farhus platform;

DISCLAIMER
Please take care and observe the following minimum requirements to protect your personal information:

• Omit using your name, address, telephone number, email, personal identification number, date of birth, bank account number, card number, other special (sensitive) data, etc., in the subject of the request or file name.
• Omit using your personal code, payment card number, and other financial information and details, health, family member details, or other specific (sensitive) data in the texts of requests, emails, or similar communication to us.
• Ensure that the remaining personal data is only indicated to us, and please ensure that the remaining personal data is only indicated to the extent necessary for the purposes for which the letter, request, or inquiry is sent. Right to delete your data.

You may access and edit, update, or delete your contact details at any time by logging into your Farhus platform Account.

Please note that you will only be able to delete your email during the de-activation of your Farhus Account. To deactivate your Account, please send your request to [email protected], and you will be provided with further guidance.

3.2. Collection of Information When Using the Platform
When utilizing the Farhus Platform or contacting us through any communication channel, we may gather information, including personal data, regarding the services you use and how you utilize them.
This information is crucial for fulfilling the agreement between you and us and enabling us to comply with legal obligations, and uphold our legitimate interest in providing and enhancing the functionalities of the Farhus Platform.

Automatic Data Collection

• Log Data and Device Information. Log data and device information are automatically gathered when accessing and using the Farhus Platform, even if you have not established a Farhus Account or logged in. This information encompasses, among other things, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.
• We are tracking Technologies and Cookies. We utilize cookies, beacons, tags, scripts, and other similar technologies such as CI codes (click tracking), ISC (source tracking), and ITC (item tracking codes). In addition, information regarding your device’s operating system, phone model, device ID, and customer number is also automatically collected. Please refer to our Cookies Policy for further information about utilizing these technologies.
• Usage Information. A tool called “Google Analytics” gathers information about your interactions with the Farhus Platform (e.g., the pages you visit, the content you view, your searches for Listings, bookings made, and other actions taken on the Farhus Platform). • Geo-Location Data. Information concerning your approximate location, as determined by data such as your IP address, is collected to provide you with an enhanced user experience and comply with relevant legal requirements such as taxes, pricing, etc. Such data may only be collected when accessing the Farhus Platform using your device.
• Clarity. We partner with Microsoft Clarity and Microsoft Advertising, capturing behavioral metrics, heatmaps, and session replays to enhance and promote our products and services. By utilizing first and third-party cookies and another tracking tech, we collect website usage data to understand the popularity of our offerings and online activity. Farhus processes this information on the legal basis of:

• Your consent;
• Concluding and fulfilling contractual arrangements and obligations between Farhus and the User;
• Pursuing the legitimate interests of Farhus as Data Controller and manager of the Farhus Platform.

4. DATA USAGE POLICY

At Farhus, we are committed to protecting the privacy and security of your personal information. This policy outlines how we use, store, combine, and process your data to provide, improve, and develop our Platform, maintain a trusted and safer environment, and comply with legal obligations.

• IDENTIFICATION. We collect and process personal identification information to verify your identity, provide support, and inform you about important updates or changes to our Terms of Use or Privacy Policy.
• TRUSTED ENVIRONMENT. We authenticate the information you provide and detect and prevent fraud, spam, abuse, security incidents, and other harmful activities from creating and maintaining a trusted environment.

Farhus may deposit your domain name registration information with a third-party escrow provider to comply with ICANN requirements.
• CONTACTING YOU. We may contact you to notify you regarding your account, troubleshoot problems, resolve disputes, collect fees or monies owed, or enforce our User Agreement, applicable national laws, and any agreement we may have with you.
• FEEDBACK. We may contact you to invite you to review any services and/or products you received from us to collect your feedback and improve our services.
• PROVIDING, OPERATING, AND IMPROVING SERVICES. We use your data to provide, operate, and improve our services, enhance data security, and prevent fraud.
• COMPLIANCE. We comply with applicable laws and regulations to protect your data and privacy.

5. JOB APPLICATIONS

At Farhus, we welcome all qualified applicants interested in applying for any open positions on our website at https://farhus.eu/career. Furthermore, applicants can send us their contact details and CV (“Applicants Information”) through the relevant Position Application Form on our website or any other means we provide.

We understand that privacy and confidentiality are crucial for our applicants and are committed to keeping the Applicant’s Information private and using it solely for the recruitment purposes of Farhus’s internal and group companies. This includes identifying applicants, evaluating their applications, making hiring and employment decisions, and contacting them by phone or writing.

Farhus may retain the Applicants Information submitted to it for up to one year after the applied position has been filled or closed. We collect this information to reconsider applicants for other positions and opportunities at Farhus, to use their Applicant’s information as a reference for future applications submitted by them, and if the Applicant is hired, for additional employment and business purposes related to their work at Farhus.

6. INFORMATION ABOUT VISITORS AND USERS OF OUR USER’S WEBSITES OR SERVICES

Farhus may collect, store, and process certain information related to visitors and users of our User’s websites or services solely on behalf of and at the direction of our Users. Our Users can collect and manage information, including personal data, through their websites. Farhus stores such information and personal data. As such, within the meaning of GDPR, Farhus may be considered a “data processor” of such information relating to visitors and users of our User’s websites or services in certain limited cases, as specified in our Terms of Service.

The Users who control and operate these User websites are considered “data controllers” of such information and are solely, completely, and entirely responsible for complying with all applicable laws and regulations, including all privacy and data protection laws of relevant jurisdictions, that may apply to the collection and control of such information.

10. RETENTION AND DELETION

We will generally keep your personal information for as long as we need to provide our services and meet our legal obligations. Once your personal information is no longer required, we will ensure its secure deletion.

If you wish to stop us from using your personal information, you can ask us to delete your personal information and close your Farhus Account.

After deactivating your Account, we will still retain specific data for compliance with legal requirements, such as tax, accounting, legal reporting, AML, and other obligations.

• This data includes a profile with depersonalized information, such as purchased services, login information, payment information, etc. In addition, we will change your email to [email protected] and remove your name, surname, and contact information.

Please note that we may retain some of your personal information for the following reasons:

• For our legitimate business interests, such as fraud detection, prevention, and enhancing safety. If we suspend your Farhus Account for safety reasons, we may retain certain information from that Account to prevent you from opening a new account.
• To the extent necessary to comply with our legal obligations, we may keep some of your information for tax, legal reporting, and auditing purposes.
• Forum posts or other publicly visible information may continue to be publicly available on the Farhus Platform even after your Farhus Account is deactivated. However, the attribution of such information to you will be removed. Additionally, some copies of your information, such as log records, may remain in our database but will be disassociated from personal identifiers.
• To resolve disputes and enforce our agreements and/or pursue or protect our legitimate interests.
• To protect the Farhus Platform from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period.
• Domain name registration data: When writing this Policy, we must provide personal information about the domain owner to register it. This information is public and is shown in the WHOIS directory. For more information, please visit https://www.icann.org/registrants.

11. DATA TRANSFERS AND USE OF THIRD-PARTY SERVICES

Personal Information of Users. Farhus and its authorized affiliates and service providers may maintain, process, and store the personal data of users in the United States, Lithuania, or Estonia, and in other jurisdictions as necessary to provide our Services and/or as required by law.  Farhus Group OÜ, the data controller, is based in Estonia, which is a member of the EU and provides an adequate level of protection for the personal data of EU residents.  Job Applicants Information. Job Applicant’s Information will be maintained, processed, and stored in Estonia, in the applied position’s location(s), and as necessary, in secured cloud storage provided by our Third-Party Services.

We are sharing Personal Data

Your Consent, We will share your Data with companies, organizations, or individuals outside our group of companies only with your consent.
Non-Personally Identifiable Information We may share non-personally identifiable information publicly and with our partners – publishers, and advertisers. For example, we may share information publicly to show trends in the general use of our platform.
Merger, Reorganization, Acquisition, or Sale If we are involved in a merger, reorganization, acquisition, or sale, we will continue to ensure the confidentiality of any Personal Data and give all affected Users appropriate notices. Domain Name Registration Data and Identification Data Domain name registration data and identification data are shared with third parties by ICANN rules.

Transfers of Personal Data Outside the EU or EEA

Standard Contractual Clauses for Data Transfers Outside the EU or EEA. The personal data of users may be transferred to processors, sub-processors, or other data recipients established in third countries (i.e., data centers and servers located outside the EU or EEA). For such transfers to be compatible with the requirements of GDPR, we have concluded relevant agreements on such data transfers outside the EU or EEA, which comply with the European Commission-approved standard contractual clauses for data transfers from data controllers in the EU to data processors and/or controllers established outside the EU or EEA. We have deemed that the said agreements were concluded on your behalf and under your instructions, as the case may be, all in line with Art—46 of GDPR.

EU-U.S. Privacy Shield When providing hosting and other services, users’ personal data might be transferred to data recipients established in third countries and participating in the EU-U.S. Privacy Shield Framework.

Other Grounds for Data Transfers Outside the EU or EEA. The personal data of users might be transferred to data recipients established in third countries on other legal grounds compatible with the requirements of GDPR (Art. 45-49).
Transfer, Disclosure of Data to Competent Authorities. In certain situations, Farhus may be asked to disclose personal data in response to lawful requests by public authorities and other competent authorities, including when it is required to meet national security or law enforcement requirements, and will do so where permitted by local data protection laws.
Protection of Personal Data Farhus affiliates and service providers that store or process your data, as well as the personal data of your users on Farhus’s behalf, are each contractually committed to keeping it protected and secured by industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction.

If you reside in a jurisdiction that enforces “data localization” or “data residency” obligations, which requires the Personal information of its residents to be stored within the territorial boundaries of such jurisdiction, this fact comes to our attention. We may keep your Personal Information within such territorial boundaries if we are legally obliged to do so.
You agree that in doing so, we may still collect, store, and use your Personal Information elsewhere.

Despite the measures and efforts taken by Farhus, we cannot and do not guarantee the absolute protection and security of your Personal Information or any other User Content you upload, publish, or otherwise share with Farhus or anyone else.

Therefore, we encourage you to set strong passwords for your User Account and avoid providing us or anyone with any sensitive information that you believe could cause you substantial or irreparable harm if disclosed.
